Terms & conditions

The terms and conditions set forth in this agreement (also referred to as “Terms and Conditions” or “Agreement”) constitute the entire understanding and agreement between you as the tour participant (“Customer”) and Africa Awaits, LLC, a North Carolina limited liability company (“Africa Awaits,” “we,” or “us”) with respect to any and all bookings, reservations, tours or transactions made with Africa Awaits (“Tour” or “Tours”).

By booking a Tour with us, paying a deposit or signing this Agreement, you accept all of the terms in this Agreement on your own behalf and on behalf of all persons listed on the booking, including any minor under your custody, care or control (“Minor” or “Child”) (also referred to individually as, “Traveler,” and collectively, “Travelers”), and direct us to perform services for each and every Traveler.

RESERVATIONS, ACCEPTANCE OF BOOKING, AND PAYMENTS.

A booking is not accepted, and there is no contract for services between us, until the required deposit is paid and you receive written confirmation from us. We reserve the right to treat any reservation that is not fully paid according to the reservation and payment terms as a cancellation and subject to the cancellation terms below.

We recommend that you refer to these Terms and Conditions prior to travel to familiarize yourself with the most up-to-date version available.

RISKS/SAFETY.

Travel to certain destinations may involve greater risk than others. Africa Awaits urges customers to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, and www.cbp.gov.

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, AFRICA AWAITS DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CUSTOMER’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CUSTOMER’S OWN RISK.

You agree to be financially responsible for all of your travel bookings (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of Africa Awaits communications by Minors under your name or account. You also warrant that all information supplied by you or members of your household transacting business with Africa Awaits is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservations facilities provided by Africa Awaits shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act.

Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree to abide by the terms and conditions of purchase imposed by Africa Awaits and any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels, cruises, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in Africa Awaits debiting your account for any costs Africa Awaits incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through access provided by Africa Awaits.

PAYMENT AND INVOICES.

Africa Awaits has a designated checking account for client deposits and payments as required. Payments into this account will be accepted in USD as ACH bank transfers or wire transfers. Payment from a credit card may be accepted and would incur a 4% additional fee for processing and bank fees incurred by Africa Awaits.

Africa Awaits will supply a final quote in USD which invoiced payments will be based on. However, should the Rate of Exchange from USD to the currency of the destination of travel country or countries waiver by 5% or more in either direction, Africa Awaits reserves the right to re-quote, and subsequent invoices will be based on the updated quote which will replace the previous final quote. The Customer agrees to pay invoices based on the most recent final quote.

If you have any questions regarding the payment instructions, you must call our office before making payment to verify the payment details. Africa Awaits will not be held financially liable for payments that are sent to fraudulent accounts.

CANCELLATIONS BY YOU AND REFUNDS.

All cancellations must be made in writing to Africa Awaits. Cancellations are only effective when we receive your written notice of cancellation.

Final payment is due prior to departure according to each supplier’s terms and conditions. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. As a result of such cancellation, Africa Awaits’ and third-party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, each supplier’s websites and www.africaawaits.com.  Africa Awaits will refund you 100% of whatever the supplier refunds to us, except for our cancellation charges as detailed on your Africa Awaits invoice.

The following Africa Awaits cancellation charges apply, irrespective of property or lodge:

20% of tour price is forfeited for cancellation 46+days prior to departure.

31-45 days prior to departure: 40% of tour price is forfeited

8-30 days prior to departure: 75% of tour price is forfeited

1-7 days prior to departure: 100% of tour price is forfeited

All cancellation fees will be charged to the credit card you authorized to pay for travel services or deducted from the supplier’s refund. If transportation or other services are canceled by Africa Awaits, all sums paid to Africa Awaits for services not performed in accordance with the contract between Africa Awaits and the Customer will be refunded within thirty (30) days of receiving the funds from the supplier with whom the services were arranged, or if the funds were not sent to the supplier, the funds shall be returned within fourteen (14) days after cancellation by Africa Awaits to the Customer unless the Customer requests Africa Awaits to apply the money to another travel product and/or date.

There may be some services on a booking which require full payment or a deposit at time of confirmation. These include, but are not limited to, scheduled flights, Festive Season deposits and extraordinary property deposits. These are payable on receipt of invoice and are non-refundable, and these deposit payments are over and above the cancellation charges stated above.

No refund will be made for no-shows, even if they are caused by a flight, another delay or for any other reason. No refunds will be provided for unused services whilst travel is under way, or if you should leave your Tour early for any reason or be removed from the Tour.

There are no exceptions to this cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, airline default, strikes, personal, family or medical emergencies, your decision not to go on a Tour because of governmental/travel warnings or advisories, including but not limited to US State Department or World Health Organization warnings, or any other circumstances beyond our control.

ALTERATIONS TO CONFIRMED BOOKINGS.

If you request to change any portion of your confirmed arrangements prior to departure, we will attempt to assist you but cannot guarantee that we will be able to meet your request.  If we are able to accommodate such a change, we have the right to charge an administrative fee of $150.00 per change per party. Potential changes include dining reservations, activities, and accommodations and each change per party is considered a separate charge.  Substantial change requests such a change of Tour dates will normally be treated as a cancellation of the original booking and rebooking in which case cancellation charges will apply.  An administrative fee of $100 per person is required to initiate a name change on the itinerary. There may be other charges associated with the name change request that will be due.

CANCELLATIONS AND CHANGES BY US.

Africa Awaits reserves the right to cancel, alter, modify, postpone or reschedule any Tour without prior notice for the safety and/or comfort of clients and for circumstances of Force Majeure.  “Force Majeure” means, in relation to Africa Awaits, any circumstances beyond the reasonable control of Africa Awaits, including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel, including any spread thereof, foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affects domestic and/or international travel, government restrictions or warnings, diplomatic or health organization warnings, border closings, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences and unforeseen circumstances.

Africa Awaits shall not be deemed to be in breach of these Terms and Conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder as a result of any actions that it takes or does not take under this section and this Agreement.

You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors.

If, prior to departure, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives. Any changes that we make may require a supplemental payment from you. We will advise you in the event such a payment is required.

If Africa Awaits, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip.  Payment of any refund by Africa Awaits to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion. However, Africa Awaits shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to Africa Awaits of the Force Majeure and applicable cancellation fees.

Regarding civil unrest, once Africa Awaits has investigated the prevailing situation, as it deems fit, it shall remain in Africa Awaits’ sole and absolute discretion whether to proceed with the trip. If Africa Awaits is of the reasonable opinion that the trip may proceed, you may in such circumstances cancel the trip subject to each supplier’s terms and conditions, including the cancellation provisions of this Agreement.

AIRLINES AND TRANSPORTATION SERVICES.

Note: UNLESS SET FORTH IN WRITING, AIRLINE RESERVATIONS MAY NOT BE INCLUDED IN YOUR TRAVEL PLANS. In such event, it is the Customer’s responsibility to make appropriate air arrangements, as well as arrangements for transportation to and from the destination where the travel booking originates and returns. The Customer is responsible for all cancellations, transfer and modification charges and change fees in connection with the airline reservations.  Africa Awaits shall not assume any responsibility for any air and/or ground schedule changes, delays, cancellations, missed connections, mechanical problems, inclement weather, screening and security delays, check-in issues, refused boarding, or baggage issues.

TRAVEL DOCUMENTS.

You and those traveling with you assume the sole responsibility to independently confirm all documentation requirements and other entry/travel requirements of each of your destinations and to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. You hereby release Africa Awaits from any and all damage incurred as a result of your failure to comply with applicable travel requirements.

Africa Awaits strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. Non-United States citizens may require additional documentation. See: help.cbp.gov/app/answers/detail/a_id/268/kw/travel and check with your local embassy or consulate. The US Customs and Border Protection Agency requires that for USA child groups under age 19 arriving by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader.

INDIVIDUAL ENTRY AND EXIT REQUIREMENTS.

Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (See: travel.state.gov/travel/cis_pa_tw/cis/cis_4965.html) Africa Awaits feels it is an invasion of privacy for any member of our staff to make such an inquiry. For example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers. (See: www.cic.gc.ca/english/information/faq/inadmissibility/index.asp)

HEALTH AND SECURITY REQUIREMENTS.

It is your responsibility to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. Africa Awaits shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by the Customer's health practitioner on a valid vaccination certificate, which the Customer must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the USA State Department website travel.state.gov, for relevant information relating to travel to specific destinations, and the USA Centers for Disease Control www.cdc.gov/travel/camerica.htm relating to health issues. For further information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States visit www.tsa.gov, www.dot.gov, www.faa.gov.us, www.ustreas.gov, www.cbp.gov Please note that USA rules regarding entry and exit change on a daily basis. Important information: see ostpxweb.dot.gov/policy/safetyenergyenv/disinsection.htm for notice of insecticides used by air carriers depending on itinerary.

RESPONSIBILITY AND DISCLOSURE.

Africa Awaits is not the source or supplier of the travel services requested and acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services abroad. Each of these companies is an independent entity with its own management and is not subject to the control of Africa Awaits. You acknowledge that the suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and consent to the use of those suppliers, and understand and agree that each supplier’s terms and conditions are contained in printed form and/or on their respective websites governing the trip. All bookings are accepted by Africa Awaits as agent for independent overseas ground and tour operators on your itinerary. The transportation, accommodations and other services provided by the identified sea, ground, and air operators offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including terms and conditions on their respective websites, and are subject to the local laws and regulations of the relevant country.  Africa Awaits does not have the right to control the operations of the independent operators and their suppliers, and such Africa Awaits IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE which may arise out of these services. You acknowledge that Africa Awaits is not responsible for the willful or negligent acts and/or omissions of such suppliers or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services.

Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage, and you will be bound by these as far as the relevant common carrier or supplier is concerned. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other supplier, and they are often also subject to various international conventions.

Weather conditions, including but limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are outside of the control of Africa Awaits. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by third party suppliers, which is beyond the control of Africa Awaits.

TOUR PRICES.

Tour prices include Africa Awaits’ planning, handling and operational charges in addition to supplier costs and fees (typically non-refundable), are quoted in U.S. dollars and, subject to these Terms and Conditions, are based on the current in-house rate of exchange and tariff. Tour prices include accommodations, meals as specified, transfers, sightseeing as specified, hotel taxes, entrance fees to included features as specified, park fees, professional English-speaking guides for transfers and all tours as specified in the itinerary. Tour prices do not include international airfares and internal airfares unless otherwise specified in the itinerary; cost of passports or visas; items of personal nature such as beverages; laundry unless otherwise stated; phone calls; excess baggage; medical fees incurred; gratuities; airport departure taxes; sightseeing; game drives or meals not included in the itinerary; or travel insurance. Africa Awaits is not responsible for any errors or omissions in any quotes or advertisements, including information posted on its website, which occur as a result of its reliance on incorrect information supplied by third parties.

Prices and availability are not guaranteed and may change without notice, until your deposit/payment has been received by Africa Awaits and your booking has been confirmed by us in writing. If your deposit/payment is not received by Africa Awaits, on or before the payment due date, reservations will be automatically cancelled. In case of any appreciable variation in its cost, Africa Awaits reserves the right to adjust its rates.

OPTIONAL ACTIVITIES THAT MAY BE DANGEROUS.

During your Tour, optional activities may be offered and furnished by other independent suppliers who are not affiliated with Africa Awaits in any way. Some of these optional activities carry with them various risks, including but not limited to attack by wild or domesticated animals, equipment/mechanical problems, and unexpected weather conditions, which can cause serious personal/bodily injury. Some of these activities include, but are not limited to: (1) horseback safaris; (2) walking safaris; (3) canoe trips; (4) camel safaris; (5) gorilla and chimpanzee trekking; (6) hot air balloon trips; (7) Masai village; (8) fishing excursions; (9) elephant back safaris; (10) bungee jumping; (11) white water rafting; (12) mokoro excursions; (13) snorkeling; (14) scuba diving; and (15) vehicle safari. Please be aware that although precautions may be taken by the suppliers to guard against such dangers, your safety cannot be guaranteed. Please also be aware that you are free to participate in such activities while you are on your Tour and that these activities are not mandatory. However, you must understand that such participation will be at your own risk, and that Africa Awaits assumes no responsibility or other liability for your safety. For these reasons, we strongly recommend that you obtain comprehensive travel insurance that covers trip interruption and cancellation, as well as adequate medical insurance that covers personal injury, medical expenses, repatriation costs, and evacuation expenses incurred during your Tour. Note that insurance policies vary and may not provide coverage for the optional activities in which you might be engaged during your trip. For instance, some policies do not cover hot air ballooning while others might. Please consider the nature of your trip and the activities you will be engaged in and obtain appropriate insurance.

TRANSPORTATION ON YOUR TOUR AND LOCAL STANDARDS.

Africa Awaits cannot be held responsible for vehicle and/or equipment breakdowns or for injuries to person or property arising out of vehicle/equipment accidents which occur while on your Tour. Developing countries are not subject to the same ‘health and safety’ regulations that exist in the U.S. Many accommodations, activities, and rules are more relaxed than they would be in the U.S. Swimming pools are unlikely to be fenced or have depth markings. Steps around camps often do not have handrails and may be uneven. Camp pathways are sometimes uneven or slippery and may be unlit at night. You may come in contact with animals and insects. Some vehicles will not have seatbelts; particularly those in safari camps. Drivers may drive faster than you are comfortable with so please ask them to slow down. Life jackets may not be within reach so please ask for them. It is your responsibility to help manage your safety throughout your Tour. If you ever feel uncomfortable, please speak up.

WILD ANIMALS.

Please be aware that our Tours may take you into close contact with wild animals. Africa Awaits cannot be held responsible for any injury or incident on the Tour. Please note that the majority of the safari camps are not fenced and wildlife moves freely in and around the camps. Always follow the safety instructions from the camp staff.

INSURANCE.

Africa Awaits is not responsible for cancellation, emergency services or evacuation, accidents abroad, illness, lost luggage, flight mishaps, weather conditions, volcanic eruptions and other interruptions. As a result, Africa Awaits strongly recommends you purchase comprehensive travel insurance covering medical, accident/life, evacuation and repatriation that might arise as a result of loss, damage, injury, delay or inconvenience occurring to you, as well as any dependents and traveling companions for the duration of your Tour, including the following types of insurance:

  • Trip Cancellation
  • Trip Interruption
  • Emergency Medical Expenses
  • Emergency Evacuation/Repatriation of Remains
  • Trip Delay
  • Loss of Baggage & Personal Effects
  • Baggage Delay and more
  • Special COVID-19 provisions

To protect your investment, Africa Awaits also urges you to consider purchasing a “cancel for any reason” travel insurance policy, which requires timely action as it must be purchased soon after your initial deposit.

LIMITATION OF REMEDIES.

You agree that the sole remedy for any default by Africa Awaits arising under this Agreement will be limited to the commission and service fee actually received by Africa Awaits. To the maximum extent permitted under applicable law, Africa Awaits shall not be liable for any special, consequential, indirect, incidental or other damages arising out of this Agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Africa Awaits has been advised of the possibility of such damages. You expressly waive any right it may have to recover such damages.

I agree that any dispute concerning, relating, or referring to these Terms and Conditions, Africa Awaits' travel services, the use of the Africa Awaits website, Africa Awaits' trip brochures or any other materials that concern my trip, the trip itself, or any claim for damages due to injury or death which occurs during or in connection with my trip, shall be resolved exclusively by binding arbitration. The arbitrator and not any federal, state or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any of this contract is void or voidable. [Use of the Africa Awaits website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms and Conditions, including, without limitation, this paragraph.]

You agree that Africa Awaits may use any images, photographs or video that you sent to us or that are taken at any event or during any travel activity, in any medium including but not limited to print, electronic media, television or the Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide.
